The Supreme Court of Appeal (SCA) has ruled that the state-owned enterprise did not err when it disqualified Babcock Ntuthuko Engineering from a tender to maintain boilers at its coal-fired power stations. 

Babcock had performed outage maintenance for Eskom at a third of its coal-fired power stations from 2016 to 2022, and was the designated Original Equipment Manufacturer for boilers for several.
